01 · Who We Are
"Cultus," "we," "us," and "our" refer to Cultus Auto Glass LLC, a Texas limited liability company providing mobile automotive glass repair, replacement, and related services in the Greater Houston metropolitan area. "You," "your," and "Customer" refer to the individual or entity requesting a quote or accepting service from us.
Our principal place of business is in Sugar Land, Texas. You can reach us by phone at (346) 758-0134, by email at cultusadmin@gmail.com, or through cultusglass.com.
02 · Acceptance of These Terms
By submitting a quote request, scheduling a service appointment, accepting service from a Cultus technician, or using cultusglass.com, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and Privacy Policy. If you do not agree, please do not use our website or services.
You represent that you are at least eighteen (18) years of age, that you are authorized to enter into this agreement, and—if you request service for a vehicle—that you are the legal owner of the vehicle, an authorized driver, or are otherwise authorized by the owner to procure glass services for it.
03 · Our Services
Cultus provides:
- Mobile windshield replacement (OEM, OEE, and aftermarket glass options)
- Mobile chip and crack repair
- Side window, back glass, sunroof, and quarter-glass replacement
- Mirror replacement and re-bonding
- Advanced Driver Assistance System (ADAS) windshield camera calibration where required
- Mobile dispatch to your home, workplace, or other reasonable Houston-area location, twenty-four hours a day, seven days a week, subject to technician availability
We do not perform body work, frame straightening, paint, mechanical repair, or services unrelated to automotive glass. We reserve the right to decline service for any vehicle that, in our reasonable judgment, presents a safety risk, lies outside our service area, or would require equipment or parts we do not stock.
04 · Quotes & Pricing
Quotes are estimates, not binding contracts. Prices we provide—whether by phone, text, email, our website, or in person—are estimates based on the information you give us about your vehicle and the damage. They are valid for fourteen (14) days unless otherwise stated.
The final price may differ from the initial estimate if, after physical inspection of your vehicle, the technician determines that any of the following apply:
- The vehicle's actual year, make, model, trim, or VIN differs from what was reported
- Additional features (rain sensors, lane-departure cameras, heads-up display, heating elements, antennas, acoustic interlayers) require a different glass part
- Hidden corrosion, prior poor-quality installation, or non-standard adhesive residue requires additional preparation time
- OEM glass is requested or required and was not specified in the original quote
- ADAS calibration is required and was not included in the original quote
If the final price increases by more than ten percent (10%) from the written estimate, we will notify you and obtain your verbal or written approval before beginning work. You may decline and cancel without obligation in that event.
05 · Scheduling & Cancellation
We will provide an estimated arrival window when scheduling. Mobile service depends on traffic, weather, prior-job complexity, and parts availability, and we cannot guarantee an exact arrival time.
You may reschedule or cancel without charge by contacting us at least two (2) hours before the scheduled arrival window. Cancellations made after a technician has already been dispatched to your location may be subject to a trip fee of up to fifty dollars ($50) to cover travel time and fuel.
If our technician arrives within the scheduled window and is unable to complete the service because the vehicle is unavailable, the location is inaccessible, or no authorized adult is present, we may charge a no-show trip fee of up to fifty dollars ($50). We will waive this fee in good faith for first-time miscommunications.
06 · Payment Terms
Payment is due in full at the time of service unless we have agreed to direct insurance billing in writing. We accept cash, debit card, major credit cards (Visa, Mastercard, American Express, Discover), Apple Pay, Google Pay, and Zelle. Personal checks are accepted by prior arrangement only.
Prices include parts, mobile dispatch, primary labor, and ordinary materials. Sales tax is added where required by Texas law. Tip is never expected.
Past-due balances bear interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted by Texas law. You agree to pay reasonable collection costs and attorneys' fees if collection becomes necessary.
07 · Lifetime Leak Warranty
For as long as you own the vehicle, Cultus warrants that any windshield or auto glass we install will not leak, will not delaminate at our installation seams, and will not develop wind-noise from defects in our installation workmanship. If a covered defect appears, we will re-seal or replace the affected glass at no charge to you, including parts and mobile dispatch within our service area.
Adhesive failure at the urethane bead, water leaks attributable to our seal, primary moulding seating, and trim-clip retention—for as long as you own the vehicle.
What's not covered:
- New impact damage (rocks, hail, vandalism, accidents)
- Stress cracks originating from a chip we did not repair or that was not disclosed
- Damage caused by car washes that use abrasive brushes or that direct high-pressure water at the installation within seventy-two (72) hours of installation
- Modifications to the glass after installation (tint film applied within forty-eight (48) hours, drilling, aftermarket camera mounts attached to the glass)
- Defects in the glass itself that the manufacturer covers under its own warranty (we will assist you with the claim)
- Any vehicle that is sold, gifted, or otherwise transferred to a new owner; this warranty is non-transferable
- Pre-existing rust or corrosion of the pinch-weld that was disclosed and accepted at the time of service
To make a warranty claim, contact us at (346) 758-0134 or cultusadmin@gmail.com within thirty (30) days of discovering the defect. We will inspect the work and remedy any covered issue promptly.
08 · ADAS & Sensor Calibration
Many modern vehicles use cameras, radar, and other sensors mounted on or near the windshield to support Advanced Driver Assistance Systems (ADAS) such as forward-collision warning, automatic emergency braking, lane-keeping, and adaptive cruise control. When a windshield is replaced, the manufacturer typically requires recalibration of these sensors.
If your vehicle requires calibration, we will tell you before service and quote the cost separately. If you decline calibration, you do so at your own risk and against our recommendation, and you waive any claim against Cultus arising from improperly calibrated ADAS, including but not limited to false alerts, missed alerts, or system disablement. Cultus is not responsible for accidents, injuries, or damage caused by ADAS sensors that have not been recalibrated after a glass replacement at your direction.
09 · Insurance Claims
Most Texas comprehensive auto insurance policies cover windshield repair and replacement, sometimes with the deductible waived. Cultus is happy to assist you with the claim process, including filing on your behalf with most major carriers.
We are not your insurance agent, broker, or representative. We do not interpret your policy, advise you on coverage, or guarantee what your insurer will or will not pay. The contract of insurance is between you and your insurer. You remain responsible for any deductible, depreciation, betterment charge, or non-covered amount.
If your insurer pays Cultus directly, you assign to us only the portion of any insurance proceeds attributable to the glass services we performed. You retain the right to pursue your own claim against your insurer for any other matter.
10 · Vehicle Access & Property
You agree to provide reasonable access to the vehicle at the agreed location, with the keys available and the work area cleared of obstacles. You acknowledge that mobile glass installation requires ambient temperature above approximately forty (40) degrees Fahrenheit, dry conditions or shelter, and a roughly ten-foot clearance around the vehicle.
Personal items left in the vehicle: we encourage you to remove valuables and documents from the dashboard and front seats before service. Cultus is not responsible for loss, theft, or damage to personal property left in the vehicle, and we will not retrieve, organize, or relocate items inside the vehicle except as necessary to perform the glass work.
Pre-existing condition: any rust, corrosion, dents, prior-installation damage, or unrelated cosmetic issues observed by our technician will be documented in writing or photograph before service begins. Cultus is not responsible for the worsening of pre-existing conditions disclosed before service.
11 · Limitation of Liability
To the fullest extent permitted by Texas law:
- Cultus's total cumulative liability arising out of or relating to the services, this agreement, or your use of our website is limited to the amount you paid Cultus for the specific service that gave rise to the claim, or fifty dollars ($50) if no service was paid for, whichever is greater.
- Cultus is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, loss of income, loss of business opportunity, rental-car expense, or diminution in vehicle value, even if we have been advised of the possibility of such damages.
- Our website and the information on it are provided "as is" and "as available," without warranties of any kind, express or implied, except as expressly stated in this agreement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent any such limitation is held unenforceable, our liability shall be limited to the smallest amount permitted by applicable law.
12 · Indemnification
You agree to defend, indemnify, and hold harmless Cultus Auto Glass LLC and its members, employees, agents, and contractors from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of this agreement, (b) misrepresentation of vehicle ownership or authority, (c) your direction to install non-OEM glass or to skip ADAS calibration against our recommendation, or (d) personal property left in the vehicle.
13 · Disputes & Governing Law
Governing law. This agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Informal resolution first. Before filing any formal claim, you agree to contact us in writing at cultusadmin@gmail.com describing the dispute and the resolution you seek, and to give us thirty (30) days to respond and attempt resolution in good faith.
Venue. If informal resolution fails, the parties agree that the exclusive venue for any litigation shall be the state or federal courts located in Harris County, Fort Bend County, or the Southern District of Texas, Houston Division. The parties consent to personal jurisdiction in those courts.
No class actions. Each party may bring claims only on its own behalf and may not consolidate, join, or otherwise participate in a class, collective, or representative proceeding, except where prohibited by law.
Statute of limitations. Any claim arising out of or relating to this agreement must be brought within one (1) year after the cause of action accrues, except where a longer period is required by applicable law.
14 · Privacy Policy
Cultus Auto Glass LLC respects your privacy. This Privacy Policy explains what information we collect, how we use it, with whom we share it, how long we keep it, and the rights you have under the Texas Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code Ch. 541) and other applicable law.
This Privacy Policy applies to cultusglass.com, our quote forms, our calls and text messages, and our service interactions with you. It does not apply to third-party websites we link to or to information you share with our technicians outside of our service relationship.
15 · Information We Collect
A.Information you give us
When you request a quote, schedule service, or otherwise communicate with us, you may provide:
- Your name, phone number, email address, and service address
- Your vehicle's year, make, model, trim, color, and—optionally—license plate number, VIN, or photographs of the damage
- The type of glass damage and your scheduling preferences
- Insurance information, if you ask us to assist with a claim
- Payment information, processed by our payment provider (we do not store full card numbers on our servers)
- Any notes or messages you choose to send us
B.Information collected automatically
When you visit cultusglass.com, our website and its analytics tools collect:
- Your IP address and approximate location (city and state, derived from IP)
- Device type, operating system, browser, screen size, and language
- Pages you view, links you click, time on page, and scroll depth
- Referrer URL (the website you came from), and any UTM campaign tags
- A pseudonymous visitor identifier and session identifier stored in your browser's local storage and cookies
C.Information from public records
If you provide a license plate number, we use a third-party service to retrieve the corresponding Vehicle Identification Number (VIN), year, make, model, and trim, solely so we can provide an accurate quote. See Section 17 below for our notice under the federal Driver's Privacy Protection Act.
We do not knowingly collect Social Security numbers, driver's-license numbers, financial-account credentials, biometric identifiers (fingerprints, faceprints, retina scans), precise GPS coordinates beyond city level, race or ethnicity, religious beliefs, sexual orientation, immigration status, or health information. If you send us any of this voluntarily, we will not retain it longer than necessary to respond to your message.
16 · How We Use Information
We use the information we collect only for purposes that are reasonably necessary, proportionate to those purposes, and compatible with the relationship under which the information was provided. Specifically, we use it to:
- Prepare and deliver quotes to you
- Schedule, dispatch, perform, and warrant our services
- Communicate with you by phone, text message, and email about your quote and your service
- Process payments and assist with insurance claims you have authorized
- Respond to questions, complaints, and warranty claims
- Operate, secure, and improve our website and detect fraud or abuse
- Measure the effectiveness of our marketing in aggregate (no individual targeting)
- Comply with our legal obligations, including tax records, accounting, and lawful requests from authorities
We do not sell your personal data. We do not share your personal data with third parties for their own advertising or marketing purposes. We do not engage in profiling that produces legal or similarly significant effects about you. We do not use your information to train artificial-intelligence models for sale or licensing to third parties.
17 · License Plate Notice (DPPA)
If you choose to enter a license plate number on our quote form, you authorize Cultus Auto Glass LLC to query a commercial vehicle-data service to retrieve the VIN, year, make, model, and trim associated with that plate, for the sole purpose of preparing an accurate quote for you.
This use is permitted under the federal Driver's Privacy Protection Act, 18 U.S.C. § 2721(b)(3), as a "legitimate business need in transactions initiated by the individual to verify the accuracy of personal information," and under § 2721(b)(13), as a "use by a requester who has obtained the written consent of the individual to whom the information pertains."
We use plate-derived information only to produce your quote. We do not sell, share, or use plate data for marketing, profiling, or any other purpose. Plate numbers are deleted from our active database within ninety (90) days of an unconverted quote, or upon completion of service for a converted quote, whichever occurs first.
If you did not authorize a plate lookup or believe a plate was queried incorrectly, contact us immediately at cultusadmin@gmail.com and we will delete the record.
18 · Photographs You Upload
You may optionally upload one or more photographs of your damaged glass to help us prepare an accurate quote. By uploading a photograph, you represent that you are authorized to do so and grant Cultus a limited, non-exclusive, royalty-free license to use the photograph solely to prepare and document your quote and service.
We store uploaded photographs on a secure third-party image-hosting service (Cloudinary; see Section 21). Photographs are private to Cultus and are not published.
If you wish to grant us additional permission to use a "before-and-after" photograph in our marketing, we will ask you separately and in writing—your default upload does not grant marketing rights. We will never publish a photograph that shows your face, license plate, home address, or any identifying interior detail without separately blurring or removing those elements.
Photographs are deleted from active storage within ninety (90) days of an unconverted quote, or within twelve (12) months of completed service, whichever occurs first.
19 · Calls, Texts & Emails (TCPA)
When you provide a phone number on our website, by phone, by text, or in person, you give Cultus your prior express consent, under the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and implementing regulations, to contact you by telephone call, SMS / MMS text message, and email at the number and address you have provided, for purposes including:
- Confirming, scheduling, and completing your quote and service
- Sending appointment reminders and arrival-time updates
- Following up on outstanding quotes within a reasonable period
- Requesting a review or feedback after service
- Notifying you of your warranty status or a recall
Such communications may be sent using an automated telephone dialing system or pre-recorded voice. Consent is not a condition of purchasing any service from Cultus—you may receive a quote and service without agreeing to follow-up communications by replying STOP or asking us in writing.
You may revoke consent at any time. Reply STOP to any text from us to stop further texts. Reply HELP for help. To stop calls, ask the technician or representative on the line, or email cultusadmin@gmail.com with the subject line "Stop Calls." To unsubscribe from emails, click the unsubscribe link at the bottom of any marketing email or reply with the word "unsubscribe."
Standard message and data rates from your wireless carrier may apply. Message frequency varies and is typically no more than four (4) messages per quote inquiry and one (1) message per scheduled service.
We log the date, time, and content of each communication for our own records and to defend against incorrect claims of unauthorized contact.
20 · Cookies, Analytics & Universal Opt-Out
Our website uses a small number of essential cookies and analytics tools to operate the site, remember your session, prevent fraud, and understand how visitors find and use cultusglass.com. We use only first-party cookies and a single first-party analytics installation. We do not run third-party advertising pixels (no Facebook Pixel, no Google Ads remarketing, no TikTok pixel) on this website.
The main categories of cookies and tracking technologies we use:
- Strictly necessary — session and security cookies that keep the website functioning. These cannot be disabled.
- Analytics — Google Analytics 4, configured with IP-anonymization, no advertising features, and no cross-site identity. We use it to count visits and understand which pages help customers.
- Internal performance — a first-party visitor identifier stored in your browser's local storage that lets us count returning visitors without using a third-party tracker.
Global Privacy Control. Effective January 1, 2025, the Texas Data Privacy and Security Act requires covered businesses to honor universal opt-out signals. If your browser or extension sends a Global Privacy Control (GPC) signal, we treat that as a valid request to opt out of any data sale or targeted-advertising sharing with respect to the data we receive from your visit. (Cultus does not currently sell personal data or share it for cross-context behavioral advertising; the GPC signal is honored as a precaution and recorded in our logs.)
You may also block or delete cookies through your browser settings. Doing so may affect site functionality but will not prevent you from requesting a quote.
21 · Service Providers (Sub-Processors)
To run our business, we use the service providers listed below. Each is contractually bound to use your information only to provide services to Cultus, to follow industry-standard security practices, and not to use your information for their own purposes.

We will update this list as our service providers change. We may also disclose information when required by law, valid legal process, or to protect the safety, rights, or property of Cultus, our customers, or the public.
22 · Data Retention
We keep personal information only as long as necessary for the purpose it was collected, plus what we must keep to comply with law, defend claims, and run our business honestly.
- Unconverted quote leads — name, phone, email, vehicle details, plate, photographs: deleted from active storage within ninety (90) days if no service is performed.
- Completed jobs — service records, invoices, warranty information: retained for seven (7) years to satisfy IRS recordkeeping rules and to honor lifetime-warranty claims for as long as you own the vehicle.
- Anonymous website analytics — pseudonymous visit data: retained for fourteen (14) months, then aggregated and irreversibly anonymized.
- Communications logs — call and text records: retained for four (4) years, the federal statute of limitations for TCPA claims.
- Email correspondence — retained for three (3) years after last interaction unless you ask us to delete sooner.
23 · Your Texas Privacy Rights
If you are a Texas resident, the Texas Data Privacy and Security Act gives you the right, free of charge and twice every twelve (12) months, to ask Cultus to:
- Confirm whether we are processing your personal data
- Access a copy of the personal data we hold about you
- Correct inaccuracies in your personal data
- Delete personal data you have provided or that we have obtained about you
- Receive a portable copy of your personal data in a readily-usable electronic format
- Opt out of any sale of personal data, targeted advertising, or profiling that produces legal or similarly significant effects (Cultus does not engage in any of these, but you may submit a confirming request)
Cultus is a small business as defined by the U.S. Small Business Administration and is broadly exempt from the TDPSA's procedural requirements. We voluntarily honor the rights above as a matter of good practice.
Email cultusadmin@gmail.com with the subject "Privacy Request" and tell us what you would like us to do. We will respond within forty-five (45) days. We may need to verify your identity (typically by confirming the phone number or email on file). If we cannot fulfill the request, we will tell you why and explain how to appeal that decision to us in writing within sixty (60) days.
If you believe we have violated your rights, you may file a complaint with the Texas Attorney General's office at texasattorneygeneral.gov. The TDPSA does not provide a private right of action; enforcement rests with the Attorney General.
24 · Security & Breach Notification
We protect personal information with industry-standard administrative, technical, and physical safeguards: HTTPS encryption in transit, encrypted database storage at rest, access controls limited to authorized Cultus personnel and vetted service providers, periodic credential rotation, and least-privilege design.
No system is perfectly secure. If a breach affecting your personal data occurs and the law requires it, we will notify you and the Texas Attorney General within the time frames required by Texas Business & Commerce Code Chapter 521 (generally within sixty (60) days).
25 · Children
Cultus's website and services are intended for individuals eighteen (18) years of age and older. We do not knowingly collect personal information from children under the age of thirteen (13) and we do not direct content to children. If you believe a child has provided us with personal information, please contact us and we will delete it.
26 · Changes to These Terms
We may update these Terms of Service and Privacy Policy from time to time. The "Effective date" at the top of this page reflects the latest version. Material changes will be posted prominently on this page for at least thirty (30) days before they take effect, and where reasonable we will notify customers with active matters by email. Your continued use of cultusglass.com or our services after the effective date constitutes acceptance of the updated terms.
If you object to a change, you may stop using our website and services and contact us to delete your data, subject to the retention obligations above.
